Conditions of residence visa

In addition to the general conditions for issuance of a visa under paragraphs 44(a), (b), (c) and (d) and for the purposes of paragraph 44(e) of the Act, the following conditions are provided: for residence visas:

(a) in the case of a person referred to in clause 13(2), a visa holder:

(i) continue to be an employee of the employer on which the visa is based; and
(ii) has been authorized to start or continue working in Vanuatu under the Labor Law (Work Permit Act) [CAP 188];

(b) in the case of a person referred to in clause 13(3), the visa holder continues to receive the monthly income mentioned in that clause;

(c) in the case of a person mentioned in clause 13(4), a visa holder

(i) continue to hold the certificate of foreign investor approval issued by the Vanuatu Investment and Promotion Authority; and
(ii) if possible continue to hold the valid business license mentioned in clause 13(5);

(d) in the case of a person referred to in clause 13(6), the visa holder continues to have title to rental property of the value mentioned in that provision and receives monthly income referred to in that provision;

(e) in the case of a person mentioned under section 12 of Table 2 of the Annex, the visa holder must:

(i) continue to receive monthly income as stated in their visa application; and
(ii) continue to hold its Certificate of Company Registration issued by the Vanuatu Financial Services Commission.
